Terms of Service

1. Acceptance of Terms

By accessing or using the website zitandehygiene.co.za (the "Site") and the professional cleaning, hygiene product, pest management, waste management, and landscaping services provided by Zitande Hygiene Specialists ("Zitande", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, please do not use our Site or request our services. These Terms form a legally binding agreement between you ("you", "Client") and Zitande.

2. Services

Zitande provides commercial hygiene solutions across KwaZulu-Natal, South Africa, including: washroom hygiene services and consumable supply; commercial and industrial cleaning; integrated pest management; biological and medical waste collection; and landscaping services.

All services are performed in accordance with applicable South African legislation, including the Occupational Health and Safety Act (Act 85 of 1993), the National Environmental Management: Waste Act (Act 59 of 2008), and relevant SABS standards.

Specific deliverables, schedules, and pricing for any engagement are governed by a separate written service agreement or quotation issued by Zitande and accepted by the Client. In the event of a conflict, the executed service agreement prevails over these Terms for that engagement.

3. Quotations, Pricing, and Payment

Quotations issued by Zitande are valid for thirty (30) days from the date of issue unless stated otherwise. Prices are quoted in South African Rand (ZAR) and exclude VAT unless otherwise indicated.

Payment terms are as stipulated on the invoice. Outstanding balances may attract interest at the maximum rate permitted by law. Zitande reserves the right to suspend services for accounts in default.

4. Client Responsibilities

The Client agrees to provide safe, reasonable access to the premises and any information required for the safe and effective provision of services. The Client warrants that they have the authority to engage Zitande for the premises in question.

The Client must promptly advise Zitande of any hazards, restrictions, or site-specific requirements of which Zitande should be aware before services are rendered.

5. Health, Safety, and Compliance

Zitande is committed to maintaining the highest health and safety standards. Our personnel are trained, uniformed, and supervised. Material Safety Data Sheets (MSDS) for products used are available on request.

The Client remains responsible for notifying Zitande of any sensitive areas, occupants with specific health considerations, or regulatory inspections relevant to the scope of work.

6. Intellectual Property

All content on this Site, including text, graphics, logos, images, service marks, and the Zitande brand, is the property of Zitande Hygiene Specialists or its licensors and is protected by South African and international intellectual property laws.

You may not reproduce, distribute, or create derivative works from any Site content without our prior written consent, except for the limited purpose of evaluating or requesting our services.

7. Limitation of Liability

To the fullest extent permitted by South African law, Zitande shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, arising from or related to the use of our services or this Site.

Our aggregate liability for any claim arising out of or relating to the services shall not exceed the amount paid by the Client to Zitande for the specific service giving rise to the claim during the three (3) months preceding the incident.

8. Indemnification

The Client agrees to indemnify and hold Zitande, its directors, employees, and agents harmless from any claims, damages, or expenses (including reasonable legal fees) arising from the Client's breach of these Terms, misuse of services, or violation of applicable law.

9. Third-Party Links and Content

This Site may contain links to third-party websites or display third-party content (including Google Reviews). Zitande does not control and is not responsible for the accuracy or reliability of any third-party content, and your use of such content is at your own risk.

10. Privacy

Your use of our Site and services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in accordance with the Protection of Personal Information Act (POPIA). Please review our Privacy Policy, which is incorporated into these Terms by reference.

11. Termination

Zitande may suspend or terminate access to the Site or services at any time, with or without cause, and without notice. Upon termination of a service engagement, amounts owed to Zitande for services already rendered become immediately due and payable.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising out of or relating to these Terms or the services shall first be addressed by good-faith negotiation.

If unresolved within thirty (30) days, the dispute shall be submitted to mediation in Durban, KwaZulu-Natal, and failing resolution, to the exclusive jurisdiction of the South African courts.

13. Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted on this page with an updated "Last Updated" date. Your continued use of the Site or services after changes constitutes acceptance of the revised Terms.
